This privacy statement for Faroverse, Inc. (d/b/a Faro) (“Faro,” “we,” “us,” or “our”), applies to our websites, mobile apps, and other digital services that link to this privacy statement (collectively, our “Services") and describes how and why we might collect, store, use, and/or share (“process”) your information when you use our Services.

Information We Collect
We collect personal information and other information from and about individuals who interact with us and use our Services. We collect certain information automatically through an individual’s use of our Services, and we collect information that individuals voluntarily provide to us.

The information collected and how we use and share it depends on the manner in which individuals interact with us and our Services and the purpose for which it is being collected and is discussed further below.

Personal information you disclose to us:

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. 

Personal Information Collected for Account Creation: We collect information that you voluntarily provide to us when you create an account through our Services, such as on our website, for the purpose of utilizing our Services, including creating and minting NFTs. The information we may receive to approve the creation of an account could include: your name, email address, phone number, company, and geographic region. 

Personal Information Collected at Wallet Registration: When you act in a consumer capacity, you may use our Services to register your e-wallet.  Depending on the type of e-wallet you use, we may collect email address at e-wallet registration.

Information automatically collected:

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, the browser you use, characteristics of your device and its operating system, language preferences, referring URLs, device name, country, general location, information about how and when you use our Services, and other technical information. We also collect information through data collection tools such as cookies and similar technologies (“cookies”). For more information about cookies, see the “Use of Cookies and Other Technologies” section below. The information we collect utilizing cookies includes:

Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).

Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

Blockchain Information:

When you undertake transactions through your e-wallet, we may access data publicly available through blockchain, such as the public encryption key related to your transaction. We will never ask you to share your private keys or wallet seed through our Services. You should generally never trust anyone or any site that asks you to enter your private keys or wallet seed.

How We Use Your Information

We process your personal information for a variety of purposes, depending on how you interact with our Services, including:

  • To provide our Services, including enabling you to access and use the Services;
  • To protect our Services and those who use our Services, including fraud monitoring and prevention;
  • To identify usage trends and better understand how our Services are being used so we can improve them;
  • For marketing and market research and to determine the effectiveness of our marketing and promotional campaigns;
  • To contact you for any of these purposes and to respond to your requests or inquiries;
  • To complete a transaction;
  • To perform website analytics and measure website performance;
  • To evaluate product feedback; 
  • To maintain the Services, including for security purposes; 
  • To improve our Services and develop new products and services; and 
  • To comply with laws, regulations and/or legal process.

Sharing or Disclosing Your Personal Information
We may share or disclose personal information with our service providers who act on our behalf to provide support or other capabilities for the Services, and who are under appropriate contractual obligations with us. We may also share or disclose your personal information in order to conduct our business and pursue our business interests, including in the following situations:
a. Corporate Changes or Business Transfers.

We may transfer information, including your personal information, in connection with a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control by Faro or any affiliated company (in each case, whether in whole or in part). When one of these events occurs, Faro will use reasonable efforts to notify users before information is transferred or becomes subject to different privacy practices.

b. With Our Affiliates.

We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy statement. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.

c. With Our Business Partners.

We may partner with other companies to provide you with certain products, services, or promotions. When you register for a co-branded website or service, your registration information may be shared with one or more of Faro’s business partners. Each business partner will have its own privacy policy, and its privacy practices may differ from this Privacy Statement.

d. Social Media Plugins.

When you use the Services, Social Media operators can place a cookie on your computer to recognize individuals who have previously visited the Services. If you are logged into a Social Media account while using the Services, the social plugins allow that Social Media to receive information that you have accessed and used the Services. The social plugins also allow the Social Media operator to share information about your activities in or through the Services with other Social Media users. For example, Facebook Social Plugins allows Facebook to show your Likes and comments on our pages to your Facebook friends. Facebook Social Plugins also allows you to see your friends' Facebook activity through the Services. Faro does not control any of the content from the Social Media plugins. For more information about Social Media plugins, please refer to the privacy statements and other legal notices of the Social Media platform.

e. Legal Requirements.

In certain circumstances, Faro may release your personal information in response to a court order, subpoena, search warrant, regulation, binding order of a data protection agency, governmental request or other legal or regulatory process. Faro may disclose information if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Faro and our customers or others.

Use of Cookies and Other Technologies
We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Cookies are identifiers that facilitate the interaction between your computer or device and the Services. Different types of cookies, such as session and persistent cookies, are used for different purposes.

We may use cookies or other technologies to facilitate site navigation, personalize your experience, perform analytics, and remember your information when you use the Services. Processing Location and International Data Transfers
Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information will be stored and processed by us in our facilities and by those third parties with whom we may share your personal information, in the United States.

Regardless of where your personal information is collected or processed, Faro maintains and requires its service providers to maintain appropriate administrative, technical, and physical safeguards to protect your personal information.

We implement reasonable technical and organizational security measures that are designed to help protect personal data from accidental or unauthorized access, use, loss, destruction, disclosure, or modification when transmitting or storing personal data.

In addition, we limit access to your personal information to those employees, agents, contractors, and other third parties who have a business need to know. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

Although we will protect your personal information as described in this Privacy Statement, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

Some of our websites or interactive features may contain links to third-party websites or services that are not under our control or ownership. Such links do not constitute an endorsement of those third parties or the content displayed therein, and you agree that Faro is not responsible for the content of such websites.

We are not responsible for how these sites operate or treat your information. You acknowledge that we provide these links to you only as a convenience, and you understand if you decide to visit a third-party website or service, you are subject to its privacy practices and not this Privacy Statement.

Minors
Our Services are intended for use only by individuals who are legally considered to be adults in their jurisdiction of residence. We do not knowingly collect any personal information directly from individuals who have not reached the age of majority (minors).

Consistent with the requirements of the Children’s Online Privacy Protection Act (COPPA), if we learn that a child under age 13 has provided personal information to or through the Services, we will use that information only to respond directly to that child (or his or her parent or legal guardian) to inform the child that he or she cannot use the Services and subsequently we will dispose of such personal information in accordance with this privacy statement.

Your Privacy Rights
As stated above, we will generally only collect directly identifiable information from you through our Services with your consent.  Depending on where you reside, applicable laws may provide you with certain rights with respect to your personal data.
a. Withdrawing your consent:

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent. You can withdraw your consent by contacting us using the contact details provided at the end of this privacy statement. In some circumstances, we may not be able to stop processing your information upon your revocation of consent, such as where we are required by law to continue processing your information.

b. Cookies and similar technologies:

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services.

c. Email communications:

We may periodically send email communications that directly promote the use of our Services or third parties’ goods and services. When you receive marketing communications or promotional materials from us, you may indicate a preference to stop receiving these communications by following the unsubscribe instructions provided in the email you receive. Despite these preferences, we may send you occasional transactional service-related informational communications.

Controls for Do-Not-Track Features
Most web browsers and some mobile operating systems and mobile applications include a Do- Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.

At this time, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy statement.

Privacy Statement Updates
We may update this privacy statement from time to time. The updated version will be indicated by an updated "effective" date, and the updated version will be effective as soon as it is posted.

Any changes will be effective immediately upon posting of the revised privacy statement, and your continued use of our Services will be subject to the then-current privacy statement. We encourage you to review this privacy statement frequently to be informed of how we are protecting your information.
